General Terms and Conditions of Business

These General Terms and Conditions apply, as relevant, unless otherwise agreed in writing.

Delivery Terms

Delivery of products is Ex Works (EXW), our warehouse, in accordance with Incoterms® 2020.

Prices

Quoted prices are exclusive of VAT and do not include freight, insurance charges or other delivery costs such as packaging. Safe at Site reserves the right to adjust prices for increases beyond our control.

Payment Terms

Payment terms are 30 days from the date of delivery, unless otherwise stated. Title to the goods remains with Safe at Site until payment has been received in full. In the event of late payment, default interest will be charged at the reference rate + 8 percentage points from the due date. Any queries concerning an invoice must be raised within 8 days of receipt to be valid.

Liability, Claims and Obligations

Safe at Site’s liability for the goods ceases, and the risk passes to the purchaser, when the goods are handed over for carriage to the purchaser. Safe at Site is therefore not liable for damage arising during transport.

Any claim regarding defects or shortages must be made no later than 7 days after the goods have been delivered to the purchaser. Failure to notify within this period—where the purchaser discovered or ought to have discovered the defect—results in loss of the right to claim.

Safe at Site’s liability for compensation or damages for errors in delivery is limited to the value of the goods at delivery. Safe at Site is obliged, within a reasonable time and at no cost, to supply replacement material.

For any potential returns, the customer must first agree this with the relevant sales representative.

Purchaser’s Insolvency

If, prior to delivery, there is reasonable cause to believe the purchaser will be unable to fulfil its payment obligations, Safe at Site is entitled to request adequate security. If such security, acceptable to Safe at Site, is not provided, Safe at Site is entitled to terminate the contract.

Cancellation

We do not accept cancellation of orders for customer-specific products or products we do not normally keep in stock. If manufacture of a customer-specific product has commenced, cancellation is not possible.
